These Terms of Service (“Terms” or “ToS”) govern your use of the cannabis product ordering and delivery services provided by DirectLeaf Delivery, LLC (“DirectLeaf,” “we,” “us,” or “our”) through our website located at directleaf.com (the “Website”) and related services (collectively, the “Service”). By accessing or using our Service, you (“User” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. About DirectLeaf Delivery
A. What We Do
DirectLeaf Delivery, LLC connects consumers with licensed cannabis retailers (“Retailers”) in New Jersey to facilitate the legal purchase and delivery of cannabis products. We are not a licensed Retailer. DirectLeaf Delivery, LLC is a Class 6 New Jersey Licensed Operator, authorized to partner with licensed retailers and transport from Retailers to consumers, throughout the state of New Jersey.
B. Compliance with Applicable Laws
You may only use the Service to order and receive cannabis products in compliance with New Jersey state laws and regulations. All transactions are subject to verification of your age and identity, and you must be at least 21 years old to use the Service. Deliveries are made only to residential, and hotel addresses within New Jersey and not to any commercial business, federal property or locations where cannabis delivery is prohibited.
2. User Responsibilities
A. Account Registration
To use our Service, you must place orders directly with our dispensary partners. This might include creating an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
B. Legal Compliance
You agree to comply with all applicable laws and regulations, including but not limited to the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (‘CREAMM”). You must not use the Service for any illegal or unauthorized purpose.
3. Orders and Deliveries
A. Placing Orders
Orders can be placed through our website, that will direct you to the retailer’s menu. All orders are subject to acceptance by the Retailer and availability of products. Prices and availability are subject to change without notice.
B. Delivery Conditions
Deliveries are made by certified cannabis handlers employed by DirectLeaf Delivery, LLC. Upon delivery, you must present a valid government-issued photo ID to verify your age and identity. Deliveries will not be made to individuals who are visibly intoxicated or to addresses on federal property.
C. Delivery Limits
In accordance with New Jersey regulations, the following limits apply to each transaction:
• Up to one ounce (28.35 grams) of usable cannabis.
• Up to four grams of solid cannabis concentrate or four milliliters of liquid cannabis concentrate.
• Multiple ingestible cannabis-infused products containing an aggregate total of up to 1,000 milligrams of THC.
4. Payment
Payments for orders are processed through secure third-party payment processors. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your order to that payment method. All payments are subject to validation and authorization by the payment processor.
5. Returns and Undelivered Items
In the event that an order cannot be successfully delivered—whether due to the customer’s unavailability, failure to provide valid identification, refusal to accept the delivery, or any other reason—the undelivered items will be returned directly to the originating dispensary. DirectLeaf Delivery, LLC does not process refunds or reschedule deliveries for undelivered items. Customers are responsible for contacting the dispensary directly to arrange for a refund or to reschedule the delivery. All refund and rescheduling requests are subject to the dispensary’s policies. DirectLeaf Delivery, LLC is not liable for any fees, penalties, or product availability related to rescheduled deliveries or refunds.
6. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
7. Limitation of Liability
To the fullest extent permitted by law, DirectLeaf Delivery, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; or (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
8. Changes to the Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our Website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
